MINISTER ISSUES GUIDELINES ON THE OPERATIONS OF NEW CITIES:In line with Section 95 of the Local Governments Act CAP 243, the Minister of Local Government Hon. Raphael Magyezi has issued guidelines for the operationalization of the seven new Cities of Arua, Gulu, Fort Portal, Jinja, Masaka, Mbale and Mbarara. The Cities commenced operations effective Midnight July 1st, 2020.Addressing the media on 30th June 2020 at the Uganda Media Centre, the Hon. Minister reiterated that the phased creation of fifteen new Cities was in response to the imminent high urbanization growth rate that the country was experiencing“The creation of the new Cities is in Line with the overarching 30 year National Vision which identified the creation of Regional and Strategic Cities as one of the key drivers for the Country’s long term development Agenda,” he said.The Minister also urged the Local Governments leadership in the areas under the jurisdiction of the Cities to follow the guidelines in the execution of their mandates Hon. Raphael Magyezi, Minister of Local Government presenting a summary of the guidelines on the operationalization of Cities during a media briefing held 30th June, 2020 at the Uganda Media Centre Kampala. The Minister summarized the guidelines as follows:GovernanceThe Local Governments in the City shall bei) The City Councilii) The City Division Councils Administrative Units in the City shall be:i) Wardsii) CellsInterim City CouncilUntil the general elections for Local Governments Leaders are held, the composition of the City Councils shall be:
- Interim City Mayor
- Members of original District Council representing Sub-Counties, Town Councils, Municipal Divisions and othet electoral areas within the City areas of Jurisdiction.
- Members of the former Municipal Council.
- The following shall serve as ex-officio members to the interim City Council:
i) The Chairperson of District Women Councilsii) Members of Parliament representing constituencies within the City jurisdiction; including the District Women MPs.iii) Chair Persons of Women Councils of annexed Sub-Counties, Town Councils or former Municipal Divisions within the City jurisdictionInterim City Mayor, Deputy City Mayor and Executive Committee.The Mayor of the former Municipality elected by Universal Adult suffrage shall be the interim City Mayor, subject to Section 12 (2) of the Local Governments Acts CAP 243.The interim Mayor shall nominate from among the members of the Council an interim Deputy City Mayor and interim Executive Committee.The Executive Committee shall be composed of the Mayor, Deputy Mayor and a maximum of three Secretaries.Interim City Speaker and Deputy SpeakerThe Interim City shall neither have a Speaker nor a deputy Speaker.The interim City Mayor and Deputy City Mayor shall serve as the Speaker and Deputy Speaker respectively.Interim City Council Standing CommitteeThe Interim City Council may appoint a maximum of five interim standing committees for efficient performance of its functions.Interim City Division Council until general Elections of Local Government leaders are held, the composition of the newly created City Divisions shall be:i) All Chairpersons of the former Municipal Divisions and annexed Town Councils and Sub-Counties within the City Division jurisdiction.ii) All Councilors representing Electoral areas at the former Municipal Division, Town Council and Sub-County within the City Jurisdiction.Interim City Division Chairperson.The Interim City Division Chairperson shall be the Chairperson of the former Municipal Division, Town Council or Sub-County hosting the City Division Council Headquarters.Interim City Division Speaker, Deputy Speaker and Executive CommitteeThe Interim City Division Council shall neither have a Speaker nor a Deputy Speaker. The interim City Division Chairperson and Vice Chairperson shall serve as the Interim City Division Speaker and Deputy Speaker respectively.There shall be an Interim Executive Committee for each City Division Council composed of City Division Chairperson, vice Chairperson and a maximum of three secretaries.Interim City Division Council Standing CommitteesThe Interim City Council may appoint a maximum of five interim standing committees for efficient performance of its functions.Planning and Budgeting provisionsCity Councili) The City Council shall be the planning Authority of the City and shall perform its functions as provided for in Section 35 of the Local Governments Act CAP 243.ii) The City Council is required to prepare a comprehensive and integrated five-year development plan for the period of F/Y 2020/21 – 2024/25, incorporating plans of the City Divisions.iii) The precious bank accounts for the Municipalities, Municipal Divisions plus the annexed Sub-Counties and the Town Councils shall be closed.iv) New bank accounts shall be opened in the names of the City Councils.City Divisionsi) The City Division Council shall be the planning Authority of the City Division and shall perform its functions as provided for in Section 35 of the Local Governments Act CAP 243.ii) The City Division Council shall formulate and approve a five-year development plan for the period of F/Y 2020/21 – 2024/25.iii) The precious bank accounts for the Divisions and annexed Sub-Counties and Town Councils shall be closed.iv) New bank accounts shall be opened in the names of the names of City Division Councils.Financial ProvisionsCity RevenuesThe City Council shall automate and computerize revenue registers indicating various sources of revenues and amounts due for collection within the first six months of operations.City Division RevenuesThe City Divisions will be supported to automate and computerize revenue registers indicating various sources of revenues and amounts due for collection.Human Resources Management i) Any person being an officer or employee of the Municipal Council or the annexed areas immediately before the coming into effect of the City shall become an employee of the City.ii) The Ministry of Local Government in conjunction with the Ministry of Public Service will design and develop a Human Resource Structure that will deliver the quality of services befitting Cities.iii) The Ministry of Local Government will identify and post a suitable officer who will be assigned duties of a City Clerk until a substantive officer is recruited and posted.Assets and Liabilities Assetsi) The Ministry shall ensure equitable sharing of assets between the City Council and the District Local Government.ii) Assets of the District which include; vacant land, markets, administrative buildings, stadia, bus parks, recreational centers, community halls, forest reserves, landing sites within the territorial boundaries of the City shall be the property of the City.iii) The sharing of commercial buildings belonging to the District shall be determined on the case by case basis with guidance of the Ministry.iv) All tangible and intangible assets of the former Municipal Councils, Division Councils, annexed Town Councils and Sub-Counties falling within the territorial boundaries of the city shall be a property of the City.Liabilities.i) Verifiable liabilities incurred by the District on investments and activities falling within the territorial boundaries of the City shall be taken over by the City;ii) All liabilities incurred by the former Municipal Council, Division Councils annexed Town Councils and Sub-Counties shall be taken over by the City.iii) In case of lack of clarity, as to which Local Governments should incur the labilities the Ministry will issue guidance on a case by case basis.Physical Development Planning and Boundariesi) In the First year of operation, the physical development plans for the annexed areas shall be integrated into City Physical Development plans;ii) The Ministry of Lands, Housing and Urban Development in conjunction with the Ministry of Local Government shall undertake the demarcation of the boundaries of the cities and the Divisions within the City to ascertain the actual geographical Coverage of the Cities and Divisions. Other Guidelinesi) The headquarters of the City Council shall be the Headquarters of the former Municipal Council;ii) The Headquarters of the City Division Council shall be Located at the former Division, Sub-County of Town Council Headquarters with enough infrastructure to accommodate the headquarters;iii) Any form of disposal through sale, release or exchange of fixed Public assets within the City boundaries should be halted until further notice;iv) The Ministry will provide additional guidelines from time to time in accordance to Section 95 of the Local Governments Act CAP 243 as and when need arises.
